The Covid-19 outbreak has so far killed more than 200,000 people and frightened billions more into panic. A panic that deprives most of them of any critical sense and pushes them to make or approve stupid political decisions. A group of personalities, Red Dawn, whose correspondence was revealed by Kaiser Health News and the New York Times website, managed to impose an apocalyptic ideology: China would have declared war on us and we could only protect ourselves by confining all civilians.

But the “extraordinary” measures we are seeing are not all that extraordinary. Powerful forces were pushing toward greater censorship and surveillance of digital networks long before the coronavirus jumped out of the wet markets in Wuhan, China, and they will continue to do so once the crisis passes. The practices that American tech platforms have undertaken during the pandemic represent not a break from prior developments, but an acceleration of them.

In 2001, the Permanent Court of Arbitration’s arbitral tribunal, in Larsen v. Hawaiian Kingdom, declared “in the nineteenth century the Hawaiian Kingdom existed as an independent State recognized as such by the United States of America, the United Kingdom and various other States, including by exchanges of diplomatic or consular representatives and the conclusion of treaties.” The terms State and Country are synonymous.
