President Obama ordered a drone strike in Yemen to kill Anwar al-Awlaki, an American citizen and Islamic Imam critical of American foreign policy in the Middle East. Before releasing the drones that killed al-Awlaki and two others, the White House sought and received a Memorandum from the Department of Justice providing legal justification for the attack.
Several questions come to mind. Should the memo from DoJ authorizing the killing of an American citizen abroad without judicial due process immunize President Obama for violating the federal criminal statute that imposes criminal penalties for the extra territorial killing of an American citizen?
Could a subsequent President, a member of the opposing political party, direct a new Attorney General to investigate whether the killing of the U.S. citizen by drone attack in Yemen violated federal criminal law? If an indictment is returned against the now former President for that killing, should President Obama be allowed to claim immunity or be forced to stand trial?

At the end of April, Ukraine submitted an application to the Council of Europe for a partial suspension of certain clauses of the European Convention on Human Rights and Freedoms in the country due to martial law. On April 3, Michael Shellenberger tweeted a series of excerpts from emails by X executives dubbed, “Twitter Files Brazil”, which alleged to expose crimes by Brazilian Supreme Court Justice Alexandre de Moraes. Moraes, he claimed, had pressed criminal charges against Twitter Brasil’s lawyer for its refusal to turn over personal information on political enemies. Elon Musk quickly shared the tweets and they viralized and were embraced by the international far right, to the joy of former President Bolsonaro and his supporters. A week later, Estela Aranha, former Secretary of Digital Rights in the Brazilian Justice Ministry, revealed rot at the heart of Shellenberger’s narrative. The only criminal charge filed against Twitter Brazil referenced in the leaked emails was made by the São Paulo District Attorney’s Office, after the company refused to turn over personal data on a leader of Brazil’s largest cocaine trafficking organization, the PCC. Shellenberger had cut the section of an email about a São Paulo criminal investigation and mixed it with communications complaining about Moraes on unrelated issues. Pressed by Brazilian reporters, Shellenberger wrote, “I regret my my mistake and apologize for it. I don’t have evidence that Moraes threatened to file criminal charges against Twitter’s Brazilian lawyer.”

“The process is designed to facilitate aid directly to civilians and in this way, it advances [our goal] of overthrowing Hamas’ rule in Gaza,” the minister said.
“We will facilitate aid via the maritime route that is coordinated with the United States (security and humanitarian aspects), with the assistance of the United Arab Emirates on the civilian side,” he said. “It will include the appropriate inspections in Cyprus, and the goods will be brought by international organizations with American assistance.”

Then suddenly, last Thursday, US President Joe Biden announced that the US would also supply maritime aid to Gaza, including building a makeshift artificial port off the coast.
This already imposes a long-term US military footprint in Israeli-Gaza territorial waters rather than a “mere” series of fly-throughs.

How hard would it be for a small complement of US Marines accompanying the aid deliveries to travel a kilometer or so into Gaza and to place themselves squarely in the middle of where Israel
does notwant them?…
Moreover, US forces have been and are already on the ground.
US generals and counter-terror experts have been in and out of Israel since the start of the war, including visits to Gaza.
There are also a variety of US military personnel regularly in Israel on military and intelligence exchange programs.
US attempts to reform the PA
Speaking of intelligence, multiple times when a decision was made to try to improve and reform the Palestinian Authority security forces, it was the CIA and US special forces who came to the West Bank and Gaza to help train and prepare these forces.
It seems quite likely that the Jewish state, at some point, will ask Washington to perform the same service again in Gaza.

A broader version could involve a US-led peacekeeping force handling internal Gaza security for an indefinite period until enough Gazan Palestinians disconnected from Hamas can be convinced that taking on this role will not lead to them being slaughtered later by a resurgent Hamas.
From this perspective, the question about US forces on the ground in Gaza seems less of an if than it does a when, how many, and under more or less coordinated circumstances with Israel.
