Congrats, People Of Montana: Your Governor Is About To Blow A Ton Of Taxpayer Money On An Unconstitutional TikTok Ban

Except, of course, he’s done no such thing. He’s trampled on the 1st Amendment rights of Montanans and put their data at much greater risk. That’s because the law will require geographic tracking by TikTok, Apple, and Google to a much more significant degree than exists currently, just to figure out who is in Montana and who is not. So, by setting up this ban, he’s forcing these companies to collect more data than they otherwise would, putting that data at much greater risk.

On top of that, if China wants that data, they can just buy it from American data brokers, because we have basically nothing in place to stop them. Banning TikTok does literally nothing to help here, other than rile up some brainwashed boomers who think that China is spying on Americans through an app kids use to share dance moves.

On March 19, 2023, the Philadelphia Inquirer reported that Cabrini University fired Professor Kareem Tannous in August 2022 after pressure from outside organizations to censure and punish the professor for allegedly anti-Semitic tweets. FIRE wrote the university on April 14, 2023, explaining it cannot fire Tannous for protected extramural speech and that the university should make clear it upholds the academic freedom standards it maintains in its faculty handbook.

The authors of the United States Constitution understood that the freedom of the people to express their disagreement with government policies is absolutely vital to democracy. The First Amendment makes explicit the protections afforded to this kind of expression: Americans have the right to “peacably assemble and petition the government for a redress of grievances.” In other words, non-violent demonstration and disagreement are fundamental American values. They ensure that we have a government “by and for the people,” and that a lively debate about the direction of our country remains a constant facet of American public and political life.

However, it stands to reason that no form of expression is so aggressively assailed as disagreement with leadership. Those in positions of power have obvious interests in stifling public discourse about government lies, corruption, or ineptitude, and many of the tactics they employ to short-circuit public dissent constitute particularly insidious forms of censorship.
