Since the bill was signed into law, disabled Americans have benefited from a much wider array of protections in the workforce, in education, and in the ability to access public places and private spaces open to the public, such as stores and restaurants. But in a world where disability rights victories, and disabled people themselves, are being attacked by anti-DEI activists who have President Donald Trump’s ear, disability civil rights feel a little more fragile. Section 504 of the Rehabilitation Act, another essential and wide-ranging item of civil rights legislation, is also in peril, most notably through a lawsuit filed by 17 Republican state attorneys general and led by Texas Attorney General Ken Paxton, as my colleague Sarah Szilagy reported in October.

If true, then this is Elon admitting to an astounding level of weakness. I mean, we’ve been chronicling for nearly two years now how Elon Musk talks a good game on free speech, but at every opportunity he’s had, he has not embraced actual free speech. Instead he’s worked hard to silence or punish those who say things critical of himself. This includes filing ridiculous lawsuits against two vocal critics.

Except, of course, he’s done no such thing. He’s trampled on the 1st Amendment rights of Montanans and put their data at much greater risk. That’s because the law will require geographic tracking by TikTok, Apple, and Google to a much more significant degree than exists currently, just to figure out who is in Montana and who is not. So, by setting up this ban, he’s forcing these companies to collect more data than they otherwise would, putting that data at much greater risk.

On top of that, if China wants that data, they can just buy it from American data brokers, because we have basically nothing in place to stop them. Banning TikTok does literally nothing to help here, other than rile up some brainwashed boomers who think that China is spying on Americans through an app kids use to share dance moves.
