If it succeeds, the lawsuit would radically alter the high court’s standard for hearing cases directly from states, critics and many legal experts say, and set a dangerous precedent that judges have the power to alter election results. “Dangerous garbage, but garbage,” said elections law expert Rick Hasen.
Texas doesn’t have standing to raise these claims as it has no say over how other states choose electors; it could raise these issues in other cases and does not need to go straight to the Supreme Court; it waited too late to sue; the remedy Texas suggests of disenfranchising tens of millions of voters after the fact is unconstitutional; there’s no reason to believe the voting conducted in any of the states was done unconstitutionally; it’s too late for the Supreme Court to grant a remedy even if the claims were meritorious (they are not).

Legal experts quickly push back on Texas AG’s attempt to overturn election
Under federal law, election disputes are supposed to be resolved by six days before the Electoral College meets, a deadline known as safe harbor, which is today. The electors officially cast their ballots for president on Monday.

Paxton, who is under a federal bribery investigation, alleges Wisconsin “exploited” the coronavirus pandemic to ignore election rules, which affected the outcome of the Nov. 3 election.
“Think of the irony. We have a Texas Attorney General who is being investigated by the FBI for various improprieties … and he teams up with President Trump to try to take away the votes of the people of Wisconsin,” Gov. Tony Evers told reporters on Tuesday. “It’s irony but it’s not funny irony. It’s extraordinarily sad.”

“Petitioners do not disclose that their request is part of a coordinated effort launched this week to ‘file federal and state lawsuits challenging the presidential election results in Wisconsin, Pennsylvania, Michigan, Nevada, Georgia, and Arizona,’” the Democratic National Committee wrote in response to one such legal blitz by the Thomas More Society, a not-for-profit religious group.

“Judicial acquiescence to such entreaties built on so flimsy a foundation would do indelible damage to every future election,” he wrote. “Once the door is opened to judicial invalidation of presidential election results, it will be awfully hard to close that door again. This is a dangerous path we are being asked to tread. The loss of public trust in our constitutional order resulting from the exercise of this kind of judicial power would be incalculable.

Sidney Powell’s ‘Kraken’ Is Missing More Than a Few Tentacles
Powell, joined by Trump and Giuliani, claims Dominion Voting Systems played a key role in denying the president his rightful victory. At the heart of that allegation is a redacted affidavit from an unnamed source who calls himself “an adult of sound mine” and claims to have worked for “the national security guard detail of the President of Venezuela.” In that capacity, he says, he learned that President Hugo Chavez had commissioned Smartmatic (a different company) to “create and operate a voting system that could change the votes in elections from votes against persons running the Venezuelan government to votes in their favor in order to maintain control of the government.” Although Powell calls this document the “Dominion Whistleblower Report,” Wall Street Journal reporter Kevin Poulsen notes, “the voting software used in Venezuela has no connection to Dominion, and wasn’t used anywhere in Michigan.”

Covid-19 Likely in U.S. in Mid-December 2019, CDC Scientists Report
In analyzing the blood samples, the CDC scientists found antibodies in 39 samples from California, Oregon and Washington state collected between Dec. 13 and Dec. 16.
The findings suggest there were isolated cases of coronavirus infection on the U.S. West Coast in mid-December, the scientists wrote.
They also found 67 samples with antibodies in Massachusetts, Michigan, Wisconsin or Iowa, and Connecticut or Rhode Island collected between Dec. 30 and Jan. 17.
